având în vedere Directiva 67/548/CEE a Consiliului din 27 iunie 1967 privind apropierea actelor cu putere de lege și a actelor administrative referitoare la clasificarea, ambalarea și etichetarea substanțelor periculoase, astfel cum a fost modificată ultima dată de Directiva 98/73/CE a Comisiei și, în special, articolul 28 al acesteia,

întrucât anexa I la Directiva 67/548/CEE conține o listă de substanțe periculoase menționând pentru fiecare dintre ele clasificarea și modalitățile de etichetare; întrucât, din cunoștințele științifice și tehnice actuale, reiese că lista cu substanțe periculoase din anexa menționată trebuie adaptată; întrucât, în consecință, sunt necesare anumite modificări în cuvântul introductiv la anexa I privind nomenclatura, formatul intrărilor, notele legate de identificarea, clasificarea și etichetarea substanțelor, precum și notele privind etichetarea preparatelor; întrucât lista de substanțe periculoase care figurează în anexa I conține substanțe pentru care s-au acordat Austriei și Suediei derogări specifice temporare în materie de clasificare și etichetare prin Actul de aderare a Austriei, Finlandei și Suediei; întrucât Actul de aderare prevede o reexaminare a cerințelor privind clasificarea și etichetarea substanțelor respective; întrucât această reexaminare implică adaptarea clasificării pentru un anumit număr din aceste substanțe;

întrucât anexa III la Directiva 67/548/CEE conține o listă de fraze indicând natura riscurilor specifice atribuite substanțelor și preparatelor periculoase; întrucât este necesar să se introducă fraze noi care să indice pericolul pentru sănătate reprezentat de anumite substanțe și preparate;

întrucât anexa IV la Directiva 67/548/CEE conține o listă de fraze indicând recomandările de prudență (S) cu privire la substanțele și preparatele periculoase; întrucât este necesară revizuirea formulării anumitor fraze de prudență (S) privind pericolele pentru sănătate și mediu; întrucât este necesară introducerea unor fraze de prudență (S) privind riscurile pentru sănătate; întrucât este necesară și introducerea de noi combinații de fraze de prudență privind utilizarea substanțelor și preparatelor periculoase;

întrucât anexa VI la Directiva 67/548/CEE conține un ghid de clasificare și etichetare a substanțelor și preparatelor periculoase; întrucât acest ghid trebuie modificat;

întrucât măsurile prevăzute în prezenta directivă sunt conforme cu avizul Comitetului pentru adaptarea la progresul tehnic a directivelor privind eliminarea barierelor tehnice din calea comerțului cu substanțe și preparate periculoase,

Articolul 1

Paragraf
Directiva 67/548/CEE se modifică după cum urmează:
Punctul 1
Anexa I se modifică după cum urmează:
Litera a
textul anexei 1 A la prezenta directivă înlocuiește textul corespunzător din cuvântul introductiv;
Litera b
intrările din anexa 1 B la prezenta directivă înlocuiesc intrările corespunzătoare;
Litera c
se adaugă intrările din anexa 1 C la prezenta directivă;
Litera d
se elimină intrările din anexa 1 D la prezenta directivă.
Punctul 2
La anexa III se introduce anexa 2 la prezenta directivă.
Punctul 3
Anexa IV se modifică după cum urmează:
Litera a
frazele din anexa 3A la prezenta directivă înlocuiesc frazele corespunzătoare;
Litera b
se introduc frazele din anexa 3B la prezenta directivă;
Litera c
se introduc frazele combinate din anexa 3C la prezenta directivă.
Punctul 4
Anexa VI se modifică după cum se indică în anexa 4 la prezenta directivă.

Articolul 2

Alineatul 1
Statele membre adoptă și pun în aplicare actele cu putere de lege și actele administrative necesare pentru a se conforma prezentei directive până la 1 iulie 2000. Ele informează de îndată Comisia cu privire la aceasta.
Alineatul 2
Statele membre comunică Comisiei textul principalelor dispoziții de drept intern pe care le adoptă în domeniul reglementat de prezenta directivă, precum și un tabel de corespondență între prezenta directivă și dispozițiile naționale adoptate.

Articolul 3

Paragraf
Prezenta directivă intră în vigoare în a treia zi de la data publicării în Jurnalul Oficial al Comunităților Europene.

Articolul 4

Prezenta directivă se adresează statelor membre.

For substances, the data required for classification and labelling may be obtained:

as regards substances for which the information specified in Annex VII is required, most of the necessary data for classification and labelling appear in the base set. This classification and labelling must be reviewed, if necessary, when further information is available (Annex VIII);

as regards other substances (e.g. those referred to in section 1.5), the data required for classification and labelling may, if necessary, be obtained from a number of different sources, for example the results of previous tests, information required by international rules on the transport of dangerous substances, information taken from reference works and the literature or information derived from practical experience. The results of validated structure-activity relationships and expert judgement may also be taken into account where appropriate.

Application of the guide criteria for substances

The guidance criteria set out in this Annex are directly applicable when the data in question have been obtained from test methods comparable with those described in Annex V. In other cases, the available data must be evaluated by comparing the test methods employed with those indicated in Annex V and the rules specified in this Annex for determining the appropriate classification and labelling.

In some cases there may be doubt over the application of the relevant criteria, especially where these require the use of expert judgement. In such cases the manufacturer, distributor or importer should provisionally classify and label the substance on the basis of an assessment of the evidence by a competent person.

Without prejudice to Article 6, where the above procedure has been followed and there is concern over possible inconsistencies then a proposal may be submitted for the entry of the provisional classification into Annex I. The proposal should be made to one of the Member States and should be accompanied by appropriate scientific data (see also section 4.1).

A similar procedure may be followed when information is identified which gives cause for concern over the accuracy of an existing entry in Annex I.

Remarks concerning peroxides

For the explosive properties, an organic peroxide or preparation thereof in the form in which it is placed on the market is classified according to the criteria in section 2.2.1 on the basis of tests carried out in accordance with the methods given in Annex V.
